Terms of Service
1. Overview & Platform Role
Enporto operates as a B2B marketplace (“Platform”) designed to connect wholesale buyers (“Buyers”) and sellers (“Sellers”).
Enporto facilitates discovery, communication, and basic logistics coordination but is not a party to the underlying commercial transaction. By using the Platform, you acknowledge that Enporto:
- is not the manufacturer, seller, buyer, importer, or exporter of listed goods
- does not take title to products listed on the Platform
- is not a party to Buyer-Seller Agreements
- does not independently guarantee product quality, legality, authenticity, certifications, compliance, or fitness for purpose
2. Listings & Representation
Sellers are solely responsible for the accuracy of Listing content, including descriptions, images, pricing, and MOQ.
Sellers warrant that Listings:
- are lawful and non-misleading
- do not infringe third-party rights
- comply with export and import regulations
- include required certifications and disclosures
Enporto does not independently verify all Listings and makes no guarantee regarding:
- product quality
- legality
- certifications
- authenticity
- availability
- regulatory compliance
3. Logistics & Delivery
Shipping terms (FOB, CIF, etc.) are negotiated directly between Buyer and Seller. While Enporto may offer logistics dashboarding tools, the responsibility for fulfillment lies with the transacting parties.
Enporto does not guarantee:
- delivery timelines
- customs clearance
- carrier availability
- shipment outcomes
- freight availability
Delays arising from customs authorities, logistics providers, force majeure events, sanctions screening, regulatory actions, or third-party failures do not create liability for Enporto.
4. Beta Features & Service Availability
Certain Platform features may be identified as beta, pilot, early-access, or experimental features (“Beta Features”).
Beta Features may:
- contain errors
- be modified
- be suspended
- be discontinued at any time
Beta Features are provided on an “as is” and “as available” basis without warranties.
5. Mediation Role
In the event of a dispute between a Buyer and Seller, Enporto may facilitate:
- communication
- documentation review
- payment holds through payment partners
- administrative coordination
Enporto does not act as judge, arbitrator, insurer, or guarantor. Final resolution of disputes is the responsibility of the transacting parties.
6. Arbitration & Governing Law
These Terms are governed by the laws of India. Disputes not resolved through mediation shall be finally resolved through arbitration administered under MCIA rules.
